Our services (“Services”) are offered on our web platform, available at www.dailyinternship.com, through which, on one side, current and former students at particular educational institutions (collectively, the "Student”) can find internship opportunities and, on the other side, companies or other public entities (collect“vely, the “Company”) may contact such students for potential internship opportunities.

Bastil s.r.l. is collectively referred to in these terms of use ("Terms of Use") as "DailyInternship", "DailyInternship Websites", "we" or "our."

"You," "your" and "user" refer to any person or entity visiting DailyInternship or using the Services.

These Terms of Use govern your use of the Services, regardless of how you access them, whether by computer, mobile device, or otherwise; and whether directly through our Services, or through any third-party website that links to them ("Linked Services"), and regardless of whether you are a registered user or a guest. 

In order to provide our Services through our DailyInternship, features, software, or website, we need to obtain your express agreement to these Terms of Use. You expressly agree to, and accept, the following Terms of Use by registering, installing, accessing, or using our Services.

Particularly, the following Terms of Use determine the legal rights and obligations of the user. Therefore, if you are not prepared to accept and fulfill all these Terms of Use, you must not access or otherwise use the Services.

 

Account Registration

DailyInternship provides a variety of Services, both online and offline, designed to improve the overall academic experience and help users save money. You may only have one DailyInternship account in using the Services. You cannot create or use more than one account, and you cannot share your account or any of the Services with third parties. All information you provide to create an account must be true, accurate and complete. You cannot impersonate any other person or use a name that is not your own. It is your responsibility to update your account information to keep it true, current and accurate.

Depending on your intended uses of our Services, you may be asked to designate your account as either a “Student Account” (i.e., for a Student) or a “Company Account” (i.e., for a Company).

If you are a Student the provisions under “A. Student Section” of these Terms of Use will apply; if you are a Company, the provisions under the entire “B. Company Section” of these Terms of Use will apply, being understood that for the generality of users the remaining provisions of these Terms of Use shall in any case apply either to Students and to Companies.

 

1. Student Section

Dailyinternship is free for Students.

When you set up an account as Student, you must also choose a password. You are solely responsible for maintaining the confidentiality of your password, and for any and all use of your account. You agree not to use the account, username, or password of another user at any time, nor to disclose your password to any third party. You agree you will not sell or share or otherwise transfer your membership or any membership rights. You agree to notify DailyInternship immediately if you suspect any unauthorized use of your account or access to your password. DailyInternship has the right to terminate your account for any reason at our sole discretion without prior notice to you.

To use the Services you must be at least 16 years old.

 

1. Company Section

DailyInternship is not free for Companies.

Indeed some of our Services offered to Companies, including the opportunity for a Company to post an internship opportunity, will be available for purchase. You are responsible for all charges incurred under your account, whether made by you or another person using your account. If for any reason DailyInternship does not receive payment for a purchase, DailyInternship may exercise its rights in law and equity, including (a) immediately suspending or terminating your account; (b) seeking collection of the outstanding amount owed; and/or (c) seeking legal action against you for the breach of these Terms. DailyInternship is not responsible for any costs or expenses in connection with any interactions between Students and Companies.

Unless otherwise agreed in writing between us and the Company, the Company will be charged with the fees provided for each Service in the price list (link) from time to time in force.

B.1. Company Section - Listing Internship Opportunities

Upon registration, a Company may contact, through our Services, students for a potential internship opportunity (a “Internship Posting”). An Internship Posting may only notify Students of a single internship opportunity, and must include, at a minimum, the following information: name of the company, position title, location, tasks description, start date, duration and languages requirements.

If DailyInternship determines, in its sole discretion, that any representation or warranty made by you pursuant to these Terms of Use is in any way false, incomplete, or inaccurate, DailyInternship may, at any time, reject, remove, or suspend or delay the posting of your Internship Posting, in whole or in part. DailyInternship may, but is not obligated to, provide you with an explanation for the rejection or removal of any of your Internship Postings from our Services.

 

You are responsible for maintaining the confidentiality of Your Company Account, profile and passwords, as applicable. You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be responsible for all uses of your DailyInternship Site registrations and passwords, whether or not authorized by you. You agree to immediately notify DailyInternship of any unauthorized use of your Company Account, profile, or passwords.

Companies are solely responsible for their postings on DailyInternship. DailyInternship is not to be considered to be an employer with respect to your use of our platform and DailyInternship shall not be responsible for any employment decisions, for whatever reason, made by any entity posting internship on DailyInternship.

You understand and acknowledge that if you cancel your Company Account or your Company Account is terminated, all your account information from DailyInternship, including saved resumes, network contacts, and email mailing lists, will be marked as deleted in and may be deleted from DailyInternship’s databases. Information may continue to be available for some period of time because of delays in propagating such deletion through DailyInternship web servers, save for data we have to maintain in accordance with the applicable laws.

 

In order to protect our DailyInternship community users from commercial advertising or solicitation, DailyInternship reserves the right to restrict the number of e-mails, which a Company may send to users to a number which DailyInternship deems appropriate in its sole discretion.

 

An Internship Posting must contain at least:

• Name of the internship position and location

• information about your organization and its business;

• implicit or explicit information describing how and/or why the Internship Posting is relevant to students and/or recent graduates from a higher education;

• what tasks the internship comprises and/or what is expected from the student;

• necessary practical information such as start date, duration, cover letter (yes/no), if the internship is paid or unpaid and when is the deadline to apply to the Internship Posting
   

An Internship Posting shall not contain:

• any hyperlinks, other than those specifically authorized by DailyInternship;

• misleading, unreadable, or "hidden" keywords, repeated keywords or keywords that are irrelevant to the internship opportunity being presented, as determined in DailyInternship’s reasonable discretion;

• the names, logos or trademarks of unaffiliated companies other than those of your customer save where previously and expressly authorized in writing by DailyInternship;

• the names of colleges, cities, states, towns or countries that are unrelated to the posting;

• more than one internship or internship description, more than one location, or more than one internship category, unless previously and expressly authorized in writing by DailyInternship;

• inaccurate, false, or misleading information; and

• material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under 16.
   

You may not use (or assist others in using) our Service to:

• post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;

• post internship that require citizenship of any particular country or lawful permanent residence in a country as a condition for the internship itself, unless otherwise required in order to comply with law, regulations, executive order, or federal, state or local government contract;

• post internship that include any screening requirement or criterion in connection with a internship posting where such requirement or criterion is not an actual and legal requirement of the posted internship;

• sell, promote or advertise products or services;

• post any franchise, pyramid scheme, "club membership", distributorship, multi-level marketing opportunity, or sales representative agency arrangement;

• post any business opportunity that requires an up front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;

• post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling;

• post jobs on any DailyInternship site for modeling, acting, talent or entertainment agencies or talent scouting positions;

• advertise sexual services or seek employees for jobs of a sexual nature;

• request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;

• endorse a particular political party, political agenda, political position or issue;

• promote a particular religion;
   

DailyInternship reserves the right to remove any Internship Posting or content from DailyInternship platform, which in the reasonable exercise of DailyInternship’s discretion, does not comply with the above Terms of Use, or if any content is posted that DailyInternship believes is not in the best interest of DailyInternship and/or the Students.

If at any time during your use of the DailyInternship Services, you made a misrepresentation of fact to DailyInternship or otherwise misled DailyInternship in regards to the nature of your business activities, DailyInternship will have title to terminate your use of our Services.

 

B.2 Company Section - Resume Database

Use of the DailyInternship user database by Companies

You shall use the DailyInternship user database as provided in these Terms of Use and in any contract You have with DailyInternship. You shall use the DailyInternship user database in accordance with all applicable privacy and data protection laws, and you agree you shall not further disclose any of the data from DailyInternship user database to any third party.

You shall take appropriate physical, technical, and administrative measures to protect the data you have obtained from DailyInternship user database from loss, misuse, unauthorized access, disclosure, alteration or destruction. You shall not share resume database seat-based license login credentials with any other party, nor share resume database pay-per-view license login credentials with any third party.

 

The DailyInternship User Database shall not be used:

• for any purpose other than as a Company seeking for Students in relation to any Internship Posting, including but not limited to advertising promotions, products, or services to any resume holders;

• to make unsolicited phone calls or faxes or send unsolicited mail, email, or newsletters to resume holders or to contact any individual unless they have agreed to be contacted (where consent is required or, if express consent is not required, who has not informed you that they do not want to be contacted); or

• to source candidates or to contact internship seekers or resume holders in regards to career fairs and business opportunities prohibited under these Terms of Use.

• In order to ensure a safe and effective experience for all of our customers, DailyInternship reserves the right to limit the amount of data (including resume views) that may be accessed by you in any given time period. These limits may be amended in DailyInternship’s sole discretion from time to time.

 

Verification

By registering with our Services, you hereby authorize DailyInternship to verify any representations and warranties you make either pursuant to these Terms of Use or within any materials submitted during the registration process, including conducting background checks, contacting any provided references, and reviewing public records. You acknowledge that while DailyInternship reserves the right to verify these representations and warranties, DailyInternship has no undertakings in such respect, and may choose not to do so, at Dailyinternship’s sole discretion.

 

Devices and Software

You must provide certain devices, software, and data connections to use our Services, which we otherwise do not supply. In order to use our Services, you consent to manually or automatically download and install updates to our Services. You also consent to our sending you notifications from time to time, as necessary to provide our Services to you.

 

Fees and Taxes

You are responsible for all carrier data plans, Internet fees, and other fees and taxes associated with your use of our Services.

 

Privacy

Since we started DailyInternship, we've built our Services with strong privacy and security principles in mind. It is therefore important that you read and understand the Privacy Policy, especially because the nature of the Services necessarily involve the collection and use of personally identifiable information and other personal data (“Personal Data”). The most current Privacy Policy will apply to any and all use of the Services. DailyInternship will not intentionally edit, modify, delete or disclose the contents of your Personal Data in connection with the Services except (a) as reasonably necessary for DailyInternship (or its service providers) to provide the Services, including processing and responding to your inputs, (b) to communicate with you, (c) as otherwise permitted under the Privacy Policy or elsewhere in these Terms of Use, (d) when DailyInternship reasonably believes that such action is necessary to conform or comply with any legal, regulatory, law enforcement or similar requirement or investigation, to protect or defend the rights or property of DailyInternship or any third party or to enforce the Terms or (e) as otherwise authorized by you.

Our Privacy Policy also explains how we use infrastructure, systems, and service providers around the world, and that we might transfer information outside of the European Economic Area. Indeed, to operate our global Services, we might need to store and distribute content and information in data centers and systems outside your country of residence. This infrastructure may be owned or operated by our service providers or affiliated companies.

 

Unauthorized Activities

You agree that you will not use our Services for: (a) any illegal or unauthorized purposes that violate any local, national, or international laws (including but not limited to import, export, copyright, trademark, employment and anti-discrimination laws); (b) contacting any other user of our Services who has requested not to be contacted; (c) stalking or harassing anyone; (d) data mining, scraping, or for releasing spiders, robots, web crawlers, or any other data gathering or extraction tools to collect any information from our Services, including any information related to the Internship Postings, except to the extent our Services are indexed by general purpose public search engines; (e) promoting any effort to compete with DailyInternship, including using our Services to provide, alone or in combination with any other product or service, any service to any third party or any use that causes a reduction or loss of business for DailyInternship as related to an existing or potential customer; (f) modifying, copying, distributing, displaying, performing, reproducing, publishing, licensing, creating derivative works from, transferring, selling any of our Services, unless otherwise authorized by these Terms of Use or otherwise agreed upon in writing with DailyInternship; (g) attempting to gain unauthorized access to DailyInternship‘s platform system or engaging in any activity that interferes with the performance of, or impairs the functionality of our Services; (h) any resale or commercial use of our Services or the user content; (i) using our Services to access or collect any personally identifiable information, including any names, email addresses or other such information for any purpose, including any commercial purposes; (j) violating or offending any community or internet standards of decency; or (k) removing, circumventing, disabling, damaging or otherwise interfering in any way with any security features of our Services aimed at preventing or restricting the unauthorized use of our Services. You may only use our Services in a manner strictly consistently with these Terms of Use. A Company may use our Services to create and maintain a culture of workplace diversity and inclusion and it may not use our Services to unlawfully discriminate against any Student.

 

Complaint and Dispute Procedures. Applicable Law

If you believe that any content or postings on our Services violates any of your rights, please notify DailyInternship by email at info@dailyinternship.com a comprehensive detailed message setting forth the following information: (a) your name or the name of your Company, if any; (b) your contact information, including your email address; (c) the nature and substance of your complaint, the specific rights at issue, and your basis for making the complaint, including the content or posting that is objectionable; and (d) the following statement: “The statements, representations, and assertions made in this message are true, complete, and accurate and I have the full legal authority to make each and every such statement, representation, and assertion and to make and be granted any demand made in this message.” 

 

If any Dispute arises, DailyInternship and the user shall attempt within the following thirty (30) days, in fair dealing and in good faith, to amicably settle such dispute. All Disputes, which cannot be amicably settled, shall be submitted to the competent court, save for DailyInternship right to sue the user before the Court of Turin (Italy).

 

These Terms of Use shall be governed by, and all disputes in connection with it shall be resolved in accordance with, the substantive law of the Republic of Italy without regard to conflict of law provisions.

Links to Other Sites

DailyInternship Website might contain links to third party web sites. These links are provided solely as a convenience to you and not as an endorsement by DailyInternship of the contents on such third-party web sites. DailyInternship is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party web sites. If you decide to access linked third-party web sites, you do so at your own risk.

 

Termination

DailyInternship may immediately terminate your access to all or any part of the Services (including without limitation, any relevant app) at any time, with or without cause, with or without notice. 
Although we hope you remain our user, you can terminate your registration and Services account, at any time and for any reason, by sending an email (that includes your email address) to info@dailyinternship.com or by going to your account settings and choosing “delete account.” 
Your registration and Services account can only be terminated by the process described above in this provision. 
Upon any termination, all rights and obligations of the parties under these Terms oF Use shall cease, and you shall immediately stop accessing and using the Services, except that (a) all obligations that accrued prior to the effective date of termination (including payment obligations, if any) and all remedies for breach of these Terms of Use shall survive, (b) DailyInternship may retain and use user content and other data and business records resulting from your use of the Services (but not in a manner that discloses your identity) and (c) the provisions of those sections of these Terms of Use that should reasonably be understood to continue in effect shall survive.

 

Warranty. Limitation of liability

We will use reasonable skill and care in providing our Services to you and in keeping it a safe, secure, and error-free environment, but we do not guarantee that DailyInternship will always function without disruptions, delays, or imperfections. Ours is an obligation of means and not of result. You use our services at your own risk and subject to the following disclaimers. we are providing our Services on an "as is" basis without any express or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, non-infringement, and freedom from computer virus or other harmful code. We do not warrant that any information provided by us is accurate, complete, or useful, that our Services will be operational, error free, secure, or safe, or that our Services will function without disruptions, delays, or imperfections. We do not control and are not responsible for, controlling how or when our users use our services or the features, services, and interfaces our services provide. We are not responsible for and are not obligated to control the actions or information (including content) of our users or other third parties. You release us and our and their directors, officers, employees, partners, and agents (collectively, the “DailyInternship Parties") from any claim, complaint, cause of action, or controversy (collectively, "Claim") and damages, known and unknown, relating to, arising out of, or in any way connected with any such Claim you have against any third parties. Your rights with respect to us are not modified by the foregoing disclaimer if the laws of your country of residence, applicable as a result of your use of our Services, do not permit it.

Notwithstanding anything to the contrary herein or elsewhere, our aggregate liability relating to, arising out of, or in any way in connection with our Terms of Use, us, or our Services shall be limited to losses that are a reasonably foreseeable consequence of such breach (except in relation to death, personal injury, or fraudulent misrepresentation) and will not exceed the amount you have paid us in the past twelve months, if any.

 

Changes to these Terms of Use. Miscellanea.

DailyInternship reserves the right at any time to modify, alter, or update these Terms of Use. Your use of our Services following any changes means that you agree to follow and be bound by the terms as changed. Any change to these Terms of Use shall be effective as to any visitor who has visited our Services before the change was made. It is the obligation of users using our Services before the change to learn of changes to the Terms since their last visit. DailyInternship may suspend or terminate your account and/or your ability to use our Services, for failure to comply with these Terms of Use, for inactivity on our Services, for providing DailyInternship with untrue or inaccurate information about yourself, for infringement upon DailyInternship proprietary rights, or for any other reason whatsoever. 

 

Unless a mutually executed agreement between you and us states otherwise, our Terms of Use make up the entire agreement between you and us regarding DailyInternship and our Services, and supersede any prior agreements.

 

You will not transfer or otherwise assign any of your rights or obligations under our Terms of Use to anyone else without our prior written consent. All of our rights and obligations under our Terms of Use or Privacy Policy are freely assignable by us to any of our affiliates, in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates, successor entities, or new owner, without the prior consent of the user, such consent to be intended as granted as from the date of acceptance of these Terms of Use as stated above, with full and final discharge of DailyInternship.

Nothing in our Terms of Use will prevent us from complying with the law.

Except as contemplated herein, our Terms of Use do not give any third-party beneficiary rights.

No failure or delay by us in exercising any of our rights under this Terms of Use shall operate or be interpreted as a waiver, or preclude the further exercise of such rights.

If any provision of these Terms of Use is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from our Terms of Use and shall not affect the validity and enforceability of the remaining provisions of our Terms of Use, and the remaining portion of our Terms of Use will remain in full force and effect.

We reserve all rights not expressly granted by us to you.

 

In certain jurisdictions, you may have legal rights as a consumer, and our Terms of Use are not intended to limit such consumer legal rights that may not be waived by contract. Also, in certain jurisdictions, you may have legal rights as a data subject, and our Terms of Use are not intended to limit such rights that may not be waived by contract.

 

While we certainly appreciate your feedback or other suggestions about DailyInternship and our Services, you understand that you have no obligation to provide such feedback or suggestions and that we may use your feedback or suggestions without any obligation to compensate you for them.
